What Happened?

US Senator Marsha Blackburn raised concerns on Friday about Meta Platforms’ (META) plan to update its commercial terms.

The Tennessee Republican chairs the Senate Judiciary Subcommittee on Privacy, Technology and the Law. She says the update could harm businesses and creators.

Blackburn says the terms give Meta “sweeping authority” to scrape content from any website tied to Facebook and Instagram business accounts.

She noted that Meta earlier removed an explicit mention of AI training, but she said the changes did not go far enough.

Her worry is the wording that lets Meta “develop” its business products with collected content. Without clear limits, she says, creators have little assurance their work is safe from AI use.

She called for Meta to withdraw the terms and “come to the table.”

Meta pushed back and said the terms apply only to its ads and business products.

It also said it is not changing how it uses web crawlers. The company said the update “isn’t about scraping news sites,” and content owners can still use robots.txt to signal their preferences.

Earlier on Friday, Meta delayed the update from October 30 to November 20. EU and UK antitrust authorities have also received complaints from publishers and advertisers.

What the Market Is Telling Us About Meta Stock

For Meta stock, the pressure is now coming from both sides of the Atlantic. A US senator has joined European publishers in questioning the terms, which raises the chance of more regulatory attention.

On the Q3 call, Meta reported total revenue of $64.6 billion, up 26%, and expects Q4 revenue of $73 billion to $76 billion.

Management said AI is helping it deliver more engaging content and better ads.

Spending is heavy, and legal costs are rising.

Q3 capital spending was $34.9 billion and free cash flow was negative $2.1 billion.

The company also took a $9.9 billion legal charge, while management said it is watching legal and regulatory matters that could hurt results.

AI is central to the company’s plans, and content access is part of that story.
