What Happened?

Meta Platforms (META) stock dropped about 3% in midday trading on Tuesday as opening arguments began in a major child privacy trial.

A group of 29 states sued the Facebook and Instagram parent company, claiming Meta violated a federal child privacy law, broke various consumer protection statutes, and encouraged addictive behavior among teens and children.

The dollar figures being thrown around are massive. Meta’s own attorneys said the company could be on the hook for as much as $1.4 trillion, which is nearly Meta’s entire stock market value. Lawyers for the states pushed back on that number, telling a judge last week that $200 billion is probably closer to a realistic outcome.

But the bigger risk for Meta Platforms stock might not be the dollar amount at all. Analysts say the real concern is whether Meta gets forced to change how its products actually work.

Gil Luria of DA Davidson pointed to features like infinite scroll and Meta’s core algorithms, tools that keep people engaged and, in turn, help Meta sell more ads. If those get restricted, it could hit the company’s advertising business directly.

Options markets are already pricing in real volatility for Meta Platforms stock. According to JJ Kinahan at Cboe Global Markets, options pricing suggests a move of about $30, or roughly 5%, through the end of August. That widens to a possible $55 move, or about 10%, by the end of September.

Not everyone on Wall Street is convinced this is a good time to buy the dip. Paul Meeks of Freedom Capital Markets said he’d rather sit on the sidelines, citing both the legal overhang and separate concerns about Meta’s heavy AI spending, which he flagged as arguably the bigger long-term issue.

Trading desks are watching closely regardless.

JPMorgan traders told clients to watch every headline coming out of the trial, warning that the case “ain’t nothing.”

Analysts expect headlines about possible algorithm or product changes to be the biggest swing factors for the stock as the trial unfolds.

Former Justice Department antitrust chief Jonathan Kanter noted that the states are also seeking unusually aggressive remedies, including forcing Meta to delete data it allegedly collected unlawfully from children and eliminate any AI models trained using that data.

He said the precedent from this case could matter well beyond Meta, potentially affecting other companies building AI frontier models too.

For context, Meta enters this trial with underlying business strength.

In its most recent quarter, the company reported total revenue of $60.8 billion, up 28% year over year, alongside net income of $15.8 billion.

That said, Meta already booked $2.4 billion in legal charges last quarter tied to ongoing proceedings, a sign the company is bracing for continued costs.
